  • "Content" refers to text, graphics, logos, images, audio, video, software, information or other materials, including but not limited to profile information, requests for professional services, company information, reviews, services, scheduling information, credentials, and other information or materials, including but not limited to product information, specifications, or product details available on or through the platform.
  • "User Content" refers to all content submitted, posted, uploaded, published, or transmitted on or through the AurketPro platform by any user, including but not limited to photographs, profile information, descriptions, requests, reviews, and messages.

Eligibility

  • To use The AurketPro Marketplace Platform, you must be at least 18 years old and have the legal capacity to enter into a contract. You may not allow persons under the age of 18 to request or receive calls, or services from Third-Party Providers on your behalf.
  • In some cases, you may be required to provide proof of age, identity, or other form of identification in order to access or use the Services. If you refuse to provide proof of age, identity, or other form of identification, you may be denied access to or use of the Services.
  • You must be the legal homeowner, authorized renter, or decision maker when scheduling or agreeing to 3rd party inspections and, or services.
  • Provide accurate and up-to-date information regarding you, the" User" or contact personnel and condition and owned areas of property, including a valid phone number.

User Requirements and Terms

  • You agree to follow all applicable laws when accessing or using the Services, and you may only use the Services for lawful purposes (e.g., you may not use the Services to do damage to a property in any form that is not owned by you or authorized by the appropriate personnel).

You acknowledge and agree that it is your obligation to ensure that the child is at a safe distance from any work performed and is within the supervision of an adult at all times.
  • You acknowledge and agree that neither AurketPro nor the Third-Party Provider is responsible for the safety of a pet or service animal in any area during service. You acknowledge and agree that you will ensure that the animal is at a safe distance or properly secured with a leash, harness, crate/carrier, or through other means and is within the supervision of an authorized adult or it's owner at all times.
  • In any issue or accident occurs with a third-party provider (such as a service professional), you agree to communicate with that provider directly to try and resolve the issue. You understand and agree that AurketPro does not provide any services and is not responsible for any damages, incidents, or accidents that may occur while using a third-party provider. It is your responsibility to research all providers before hiring them.

Modifications

AurketPro reserves the right to modify the terms of use for its services at any time. Any changes made will become effective once the modified terms are posted on the site. It is your responsibility to regularly check the site for any updates to the terms of use. Please note that AurketPro may or may not send a message or email to notify you of these changes. If you do not agree to the amended terms, you must cease using the services and provide AurketPro with written notice to remove you from any lists or communication channels associated with the services. By continuing to use the services, you indicate your acceptance of and agreement to be bound by the modified terms of use.

Marketplace Content & Services

You understand and agree that AurketPro does not sell or provide services directly. However, AurketPro may offer educational information related to projects and products associated with services for the benefit of Consumers. Any Professional Services sought or advertised on the AurketPro Marketplace Platform, including provider matches and professionals viewed, are based on customers' reviews and ratings and are not accompanied by any representation or warranty from AurketPro, unless expressly provided for herein. AurketPro does not assume responsibility or liability for any content provided by 3rd party service professionals on the AurketPro Marketplace Platform. It is your responsibility to verify all information provided by any service professional. You understand and agree that AurketPro is not directly or indirectly liable for any damages or losses that may arise from the use of AurketPro's services or the content provided on the platform. Any agreements or interactions between members, service professionals, customers, or businesses are solely between those parties. Members and service professionals waive the right to bring any claims against AurketPro related to the content provided verbally or in writing and release AurketPro from any liability associated with such content.

Third Party Professionals & Content

Listings of Third Party Professionals on the AurketPro platform may contain links to affiliated companies and other businesses that offer services, software, or sell products. If you decide to purchase any of these products or services, you will be transacting directly with these third parties, not with AurketPro.com. AurketPro holds no responsibility for evaluating or guaranteeing the offerings of these businesses or individuals, including the content on their websites. We also do not assume liability for the actions, services, products, or any content provided by these third parties. As such, we make no guarantees regarding the accuracy, completeness, or reliability of the information presented. As a user of the AurketPro platform, you understand and agree that AurketPro will not be held responsible or liable for any damages, losses, or consequences resulting from your use of the information provided. This includes, but is not limited to, financial losses, damages to property, or any other matters arising from engaging with professionals listed on our platform. It is the sole responsibility of the user to conduct thorough research and due diligence before engaging with any professional listed on AurketPro. Background Checks & Credentials

Business Verification and Responsibilities: AurketPro LLC only verifies businesses that are actively registered with the state and have the necessary trade or license verification at the time of their application on our platform. While this verification is part of the sign-up process, it does not prevent providers from offering their services. You can view the verification reports for each provider or company directly on their business listing. Please note that we do not conduct ongoing checks on providers who are no longer active or offering live services. Providers and companies listed on the platform are responsible for keeping their business profiles updated, including reporting any changes to their licenses or operations that may affect their ability to provide services.
Verification Process: AurketPro LLC verifies the legal status of third-party professionals during the sign-up process by reviewing their state registration or license information the company provides. However, we do not conduct background checks on individual professionals, or their employees. The inclusion of a professional, merchant, or any third party on the AurketPro platform does not imply endorsement or verification by AurketPro LLC.
Live Providers/Company Background Checks: Partnered providers recommended through our live services are verified annually to ensure they are actively registered with the state and possess the required trade or business licenses. However, these businesses are only verified at the time of their application and once a year thereafter. We do not conduct ongoing background checks or re-verifications outside of this annual process. While we make every effort to ensure that the providers we recommend are legally compliant and licensed, it is ultimately the user's responsibility to verify the credentials and suitability of any provider before hiring their services.

When you purchase any products or services offered by Third Party Professionals or businesses, please note that you are directly transacting with those third parties, not with AurketPro. AurketPro is not responsible for examining or evaluating the offerings of these businesses or individuals, including the content on their websites. We do not provide any warranty or assume any responsibility or liability for the actions, products, or content of these third parties or any other third parties. It is important for you to carefully review their privacy statements and other conditions of use before engaging with them. In the event of any issues with payment, including overcharges or refunds, or any other matters related to charges, you are responsible for communicating directly with the Third-Party Provider. AurketPro will not be held legally responsible for any unlawful actions or misuse of your information by the service provider or any other matters related to third-party service professionals. AurketPro shall not be liable for any damages, liability, or losses arising from or related to third-party providers.

Cashback Rewards Program

By participating in the Cashback Rewards Program ("Program") offered by Aurketpro.com ("we," "our," or "us"), you ("user," "referrer," or "referred user") agree to abide by the following terms and conditions. These terms are designed to ensure fairness, transparency, and the protection of both parties. In the event of any issues with payment, including overcharges or refunds, or any other matters related to charges, you are responsible for communicating directly with the Third-Party Provider. AurketPro will not be held legally responsible for any unlawful actions or misuse of your information by the service provider or any other matters related to third-party service professionals. AurketPro shall not be liable for any damages, liability, or losses arising from or related to third-party providers.

Eligibility To be eligible for cashback rewards, you must: Have an active account with Aurketpro.com for at least 180 days. Be a referrer, meaning you have referred users at least 1 active user who have made qualifying purchases of services or products. All referred users must also have an active account with Aurketpro.com and must have made a valid purchase. You must comply with all Aurketpro.com's rules and regulations for account use and transactions. Earning Cashback Cashback is earned when referred users purchase services or products using your referral code. Cashback Rates: For products, cashback will be between 0.2% to 0.5% of the total purchase price, subject to seasonal variations. For services, cashback will be between 0.2% to 10% of the total purchase price, depending on the specific service and any ongoing promotions. These cashback rates may change at any time, without prior notice. The rate applicable at the time of the referred user's purchase will be the rate used to calculate your cashback. Cashback will only be credited once the referred user has successfully completed their purchase.
Minimum Withdrawal You can redeem your earned cashback once your total balance reaches $50.00. Cashback balances under $50.00 will not be eligible for withdrawal or redemption. Redemption Cashback rewards will be provided in the form of a gift card of your choice. Once you have accumulated at least $50.00 in cashback, you may request redemption through your Aurketpro.com account. The processing of your cashback redemption may take approximately 7-14 business days, and delivery of the digital gift card code may take an additional 5-7 business days. Completed Purchases Only Cashback will be awarded only on completed purchases. If a referred user cancels, refunds, or disputes a transaction, the cashback associated with that purchase will be revoked. All purchases made by referred users must comply with Aurketpro.com's terms of sale. Referral Code Use Cashback rewards are earned through valid use of your referral code by referred users. The referral code must be applied at the time of purchase in order for you to be eligible to earn cashback. You are responsible for ensuring your referral code is shared properly. We do not guarantee that referred users will use your referral code or that any cashback will be earned. Program Changes We reserve the right to modify or terminate the Cashback Rewards Program at any time, for any reason, with or without notice. This may include changes to the rates, eligible products/services, or any other aspect of the Program. You will be notified via your account or email of any significant changes to the Program, but your continued participation will be considered acceptance of those changes. Account Suspension or Termination We may suspend or terminate your participation in the Cashback Rewards Program at any time if we suspect fraud, abuse, or violations of Aurketpro.com's terms of service. In the event of account suspension or termination, any outstanding cashback earned may be forfeited. Liability Disclaimer Aurketpro.com makes no guarantee regarding the amount of cashback you will earn, as it is dependent on the purchases made by referred users. We are not responsible for any errors, omissions, or issues that arise with gift card processing, delivery delays, or other technical issues related to cashback redemptions. We are not liable for any losses or damages resulting from the redemption of cashback rewards, including but not limited to lost funds or incorrect reward deliveries. Tax Responsibility You are solely responsible for any tax liabilities that may arise from earning cashback rewards. We recommend consulting a tax professional for advice on how cashback earnings may impact your taxes. Prohibited Conduct Any attempt to exploit or manipulate the Cashback Rewards Program for personal gain through fraudulent, abusive, or dishonest practices will result in immediate termination of your account and forfeiture of any accumulated cashback. AurketPro will not be held legally responsible for any unlawful actions or misuse of your information by the service provider or any other matters related to third-party service professionals. AurketPro shall not be liable for any damages, liability, or losses arising from or related to third-party providers.

Third-Party Payment Provider AurketPro.com uses Stripe as its third-party payment processor to securely handle all transactions related to services and products purchased on our website. By completing any transaction on AurketPro.com, you agree to be bound by Stripe’s terms and conditions, privacy policy, and any other applicable agreements as outlined by Stripe. Privacy and Security Both AurketPro.com and Stripe are committed to ensuring the privacy and security of your information. However, by using the payment system, you understand that your payment information and personal data may be shared between AurketPro.com and Stripe for the purposes outlined above, including fraud prevention, verification, and processing. Payment Disputes and Chargebacks If you have any issues with your payment, transaction, or charges, please contact AurketPro.com directly at support@aurketpro.com. We will attempt to resolve any concerns as quickly as possible. If a chargeback or payment dispute occurs, AurketPro.com and Stripe will work together to resolve the matter, but you may be held responsible for any chargeback fees incurred due to your dispute or unauthorized transaction. Refunds and Cancellations Refunds for purchases will be handled in accordance with AurketPro.com's Refund Policy. In most cases, refunds will be processed back through the original method of payment. Refunds may take several business days to appear on your statement, depending on your payment method. If you request a refund, it is subject to AurketPro.com's terms and conditions, as well as the approval of the refund process from Stripe. All requests for cancellations, returns, or exchanges must be directed to the seller from whom the purchase was made, as they are fully responsible for setting and enforcing their own policies. Aurketpro.com cannot be held responsible or liable for any disputes or outcomes related to cancellations, returns, or exchanges. Disclaimers, Limitations and Liabilities

You understand and agree that AurketPro LLC, its live services, affiliates, investors, employees, or licensors or partners shall not be held liable for any loss of profits, use, or data, or for any incidental, indirect, special, consequential, or exemplary damages resulting from (a) the use, disclosure, or display of your provided information, (b) your use or inability to use the service, (c) the service generally, or (d) any other interactions with us or with any other member within the network, whether based on agreement/contract, tort (including negligence), or any other legal theory, to the extent permitted by applicable law. This limitation of liability shall apply regardless of whether we have been informed of the possibility of such damages. Please note that although we make all attempts to verify the legal operations of third-party providers, AurketPro LLC does not guarantee the quality, suitability, safety, or ability of these providers. You agree that any risk arising from your use of the services, as well as any services or products obtained from third-party providers in connection with the services, remains solely with you to the maximum extent permitted by applicable law.

You understand and agree that AurketPro LLC does not control, manage, or direct any third-party providers or their scheduling, services, pricing, technicians, or any other matter related to 3rd party service professionals nor shall AurketPro be liable for any damages, liability, or losses regarding 3rd party providers. These third-party providers are not agents, apparent agents, ostensible agents, or employees of AurketPro LLC. AurketPro does not control, endorse, or take responsibility for any user or third-party content available on or linked to by the services. AurketPro cannot and does not represent or warrant that 3rd party provider websites, apps, or any software outside of aurketpro.com is free of viruses or other harmful components. You understand and agree that AurketPro shall not be liable for any damages, liability, or losses regarding personal information shared outside of the AurketPro network.

Indemnification

You agree to fully indemnify, defend, and hold AurketPro LLC, its directors, officers, employees, consultants, investors, agents, and other representatives, harmless from and against any and all claims, damages, losses, costs (including reasonable attorneys' fees), and other expenses that arise directly or indirectly from: (a) your use of and activities in connection with the AurketPro Platform, its live services, or other websites to which the AurketPro Platform is linked; (b) any information provided by you; (c) any breach or violation of these terms or any applicable laws or regulations; and/or (d) your negligent or willful misconduct.
